Terms and Conditions for Customers of Chesterfielddeals.com

These 'Terms and Conditions for Customers' apply to the relationship between Chesterfielddeals.com and the Customers.

1. Definitions

Offer: the product and service offerings of the Company that the Customer can order from the Company via the Platform.

Order: an order placed by the Customer via the Platform with the Company for the selected Offer.

Customer: a natural person or legal entity who places an Order via the Platform.

Agreement: an agreement between the Customer and the Company regarding an Order and the delivery or pickup of the Order.

Platform: the website(s), apps, tools, and other devices of Interieurberzorgd.nl and its affiliated companies and business partners where the Service is made available.

Company: a company listed on the Platform that provides, sells, prepares, packages, selects, and uses the Platform for the creation and payment of Agreements.

Company Information: the information of the Company related to the merchant and its contact details, the products and services available within its Offer (e.g., allergens, nutritional information, and ingredients), prices for each individual product and service (including VAT), company logo, graphic material, delivery area (including postal codes), delivery costs, and minimum order amounts, and other information about the Company.

Service: the commercial services and/or activities offered by Chesterfielddeals.com to the Customer, including the publication of the Offer, facilitating the formation of Agreements, and forwarding Orders to the relevant Company.

Chesterfielddeals.com: Chesterfielddeals.com acting for itself and on behalf of any legal entity or person that directly or indirectly controls, is controlled by, or is under common control with Chesterfield bv.

3. Applicability

1. These Terms and Conditions for Customers apply only to the Service. Chesterfielddeals.com is not responsible for the Offer. The general terms and conditions of the Company apply to the Offer, where applicable.

2. The Customer enters into an Agreement directly with the Company for the delivery of the Offer selected by the Customer when placing an Order.

4. The Offer

1. Chesterfielddeals.com publishes the Offer on behalf of the Companies on the Platform, in accordance with the data provided by the Companies. Chesterfielddeals.com accepts no responsibility or liability for the content of the Offer and the data on the Platform.

2. Chesterfielddeals.com presents all data in such a way that it is clear to the Customer what their rights and obligations are upon acceptance of the Offer.

3. Chesterfielddeals.com accepts no liability for the accessibility of the Platform.

5. The Agreement

1. The Agreement is concluded when the Customer finalizes the Order by clicking the 'Place Order and Pay' button during the ordering process via the Platform.

2. After receiving the Order, Chesterfielddeals.com will electronically confirm the Order to the Customer.

3. The Agreement can only be executed by the Company if the Customer provides correct and complete contact and address details when placing the Order. The Customer has the obligation to promptly notify Chesterfielddeals.com or the Company of any inaccuracies in the provided or stated payment details.

4. Regarding information about the status of their Order, the Customer must be reachable by phone or email (as indicated when placing the Order) for both the Company and Chesterfielddeals.com after placing the Order.

5. If the Customer chooses delivery of the Order, they must be present at the specified delivery address to receive the Order. If the Customer is not present at the delivery address when the Order is delivered, and the Order is delivered by Chesterfielddeals.com (instead of the Company itself), Chesterfielddeals.com will make a reasonable effort to contact the Customer to determine where and when the Order should be delivered. Chesterfielddeals.com is not responsible for the Order (including the quality or safety of the Order when the Customer receives it) once the Order has been delivered. If the Company delivers the Order itself, instead of using Chesterfielddeals.com's delivery services, the Company decides how and when the Order will be delivered in consultation with the Customer.

6. If the delivery of the Order placed by the Customer with the Company is carried out by Chesterfielddeals.com, Chesterfielddeals.com may charge the Customer delivery costs or a service fee. The delivery costs and service fee may vary depending on several factors, such as location, selected Company, order value, but these costs will always be listed on the Platform before the Customer places an Order. An invoice for the delivery costs and service fee can be requested from Chesterfielddeals.com.

7. If the Customer chooses to pick up the Order, they must be present at the chosen time at the Company's pickup location, as indicated in the confirmation email, text message, or on Chesterfielddeals.com's website.

8. When ordering and delivering or picking up Orders with age-restricted Products, Chesterfielddeals.com and the Company will request identification from the Customer in accordance with applicable laws and regulations. If the Customer cannot adequately identify themselves or does not meet the minimum age requirements, the age-restricted Products will not be delivered, and Chesterfielddeals.com and the Company are also free to refuse the entire Order. If the age-restricted Products are not delivered due to this article, cancellation fees may be charged to the Customer, which will at least consist of the value of the age-restricted Products in the respective Order.

9. Chesterfielddeals.com accepts no liability in connection with the execution of the Agreement.

6. Termination of the Agreement and Cancellation of the Order

1. If you, the Customer, are a consumer, you may have certain legal or statutory rights when ordering products via the Platform. Notwithstanding these rights (which, if applicable, remain unaffected), the Customer cannot terminate the Agreement when the goods, individually tailored to the customer, are not suitable for return or have been irreversibly mixed with other goods after delivery. Orders cannot be canceled by the Customer with Chesterfielddeals.com. Cancellation of the Order by the Customer can only take place with the Company.

2. The Company has the right to cancel the Order if, for example, the Offer is no longer available, the Customer has provided incorrect or unreachable contact details, or in the event of force majeure.

3. If the Customer places a false Order (e.g., by providing incorrect contact details, not paying, or not being present at the delivery or pickup location to receive the Order) or otherwise fails to fulfill their obligations under the Agreement, Chesterfielddeals.com may decide to refuse future Orders from the Customer.

4. Chesterfielddeals.com has the right to refuse Orders and cancel Agreements on behalf of the Company if there is reasonable doubt about the accuracy or authenticity of the Order or contact details. If the Customer appears to place false or fraudulent Orders, Chesterfielddeals.com may report this to the police.

7. Payment

1. When the Agreement is concluded in accordance with Article 5.1 of these Terms and Conditions for Customers, the Customer is obliged to pay the Company for the Order. The Customer can fulfill this payment obligation by paying with an online payment method via the Platform or by paying the Company upon delivery or at the pickup location.

2. Except as provided in Article 6 of these Terms and Conditions for Customers, (partial) chargebacks of an online payment are only possible if the Order cannot be (fully) delivered. The chargeback will always be made to the same account from which the payment was made. Depending on the payment method used by the Customer, the processing of this may take up to 10 working days.

3. The Company has authorized Chesterfielddeals.com to receive the online payment on behalf of the Company.

8. Complaints Procedure

1. Complaints from the Customer about the Offer, the Order, or the execution of the Agreement must be submitted to the Company. The exclusive responsibility for the Offer of the Company and the execution of the Agreement lies with the Company. Chesterfielddeals.com can only take on a mediating role.

2. If the Customer has a complaint about the Service, the complaint should be communicated via the contact form, by email, or in writing by mail to the customer service of Interieurberzorgd.nl at the contact address indicated in Article 2 of these Terms and Conditions for Customers.

3. After receiving the complaint, Chesterfielddeals.com will respond as soon as possible, but no later than within a week, with an acknowledgment of receipt. Chesterfielddeals.com strives to address the complaint as quickly as possible, but no later than within 2 weeks.

4. Complaints as described in paragraphs 1 and 2 of this article must be submitted within a reasonable time after the Customer has discovered the defects, fully and clearly described to the Company (paragraph 1) or Chesterfielddeals.com (paragraph 2).

9. Newsletter

When completing the Order, the Customer can also choose to receive the newsletter. The Customer can unsubscribe from this newsletter via www.chesterfielddeals.com/newsletter or by contacting customer service using the contact details provided in Article 2 of these Terms and Conditions for Customers under 'Correspondence Address'.

10. Access and Correction of Stored Personal Data

Chesterfielddeals.com processes the Customer's personal data. The processing of personal data is subject to the Privacy Statement.
